These Terms of Service ("Terms") govern your use of the NGActivewear online store at ngactivewear.co.uk (the "Store"). By placing an order, you agree to these Terms. If you do not agree, please do not use the Store.

The Store is operated by NGWorld Trading Ltd, a company registered in England and Wales, with registered address at 45 Melchett Road, Kings Norton Business Centre, Birmingham B30 3HP, United Kingdom.

2. Products and pricing

We make every effort to display our products and prices accurately. Prices are shown in GBP and include VAT where applicable. If we discover an error in the price of a product you have ordered, we will inform you and give you the option of reconfirming your order at the correct price or cancelling it for a full refund.

Product colours may vary slightly from how they appear on screen due to display settings and photography.

3. Orders and contract formation

When you submit an order, you are making an offer to purchase. A contract is formed only when we send you an order confirmation email and dispatch your goods. We reserve the right to decline or cancel any order, for example where a product is out of stock or we suspect fraud — in which case you will receive a full refund.

4. Payment

We accept the payment methods shown at checkout. Payment is taken when you place your order. If your payment cannot be authorised, your order will not be processed.

5. Delivery

Delivery options, rates and estimated timeframes are set out in our Shipping Policy. Risk in the goods passes to you on delivery. If your goods arrive damaged, contact us within a reasonable time and we will arrange a replacement or refund.

6. Returns and refunds

You may return products in accordance with our Refund Policy, which gives you 30 days from delivery to request a return or exchange. This is in addition to your statutory rights, including the 14-day cooling-off period for distance sales under the Consumer Contracts Regulations 2013 and your rights under the Consumer Rights Act 2015, which are not affected by these Terms.

7. Promotions and discount codes

Discount codes are subject to their stated terms, cannot be applied retrospectively after an order is placed, and cannot be combined unless we say otherwise. We may withdraw or amend promotions at any time.

8. Intellectual property

All content on the Store — including text, images, logos and designs — is owned by or licensed to NGWorld Trading Ltd and protected by intellectual property laws. You may not reproduce, distribute or exploit it without our prior written consent.

9. Acceptable use

You agree not to misuse the Store, including by introducing malicious software, attempting unauthorised access, or placing fraudulent orders. We may suspend or cancel orders and accounts where we reasonably suspect misuse.

10. Liability

Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, fraud, or breach of your statutory consumer rights. Subject to that, our total liability for any order is limited to the price you paid for the products in that order. We are not liable for indirect or consequential losses.

11. Governing law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales. If you live in Scotland or Northern Ireland, you may alternatively bring proceedings in your local courts.

12. Changes to these Terms

We may update these Terms from time to time. The version in force at the time you place your order applies to that order.
